CBP BES LEGT LAST ONDER DWANGSOM OP AAN OPENBAAR LICHAAM BONAIRE WEGENS HERHAALDELIJKE SCHENDING PRIVACYWETGEVING
Kralendijk,- De Commissie Toezicht Bescherming Persoonsgegevens BES (CBP BES) heeft met onmiddellijke ingang besloten een last onder dwangsom op te leggen aan het Openbaar Lichaam Bonaire (OLB).
Dit besluit komt voort uit het herhaaldelijk niet naleven van cruciale afspraken omtrent de bescherming van persoonsgegevens van burgers op Bonaire. Ondanks herhaalde waarschuwingen, heeft het OLB nagelaten noodzakelijke maatregelen door te voeren, waardoor de persoonsgegevens van inwoners nog steeds kwetsbaar zijn voor misbruik.
Reactie van het OLB
In een reactie van 23 september 2024 op het voornemen van de commissie tot het opleggen van de last heeft het OLB aangegeven dat er in 2022 en 2023 financiële middelen beschikbaar zijn gesteld om de aanbevelingen van CBP BES te implementeren en dat een aantal maatregelen is doorgevoerd. Desondanks is het OLB er niet in geslaagd om alle vereiste maatregelen tijdig en volledig uit te voeren. Het OLB geeft als reden organisatorische obstakels, zoals de verspreiding van ambtenaren over meerdere gebouwen en beperkte werkruimte.
Hoewel het OLB aangeeft dat er enige vooruitgang is geboekt, zoals de invoering van toegangspasjes en de vervanging van niet-afsluitbare kasten, blijft de bescherming van persoonsgegevens ernstig tekortschieten. Dit baart de Commissie zorgen.
Beoordeling van de zienswijze
De CBP BES vindt het zorgwekkend dat de persoonsgegevens van burgers nog steeds onvoldoende beschermd zijn, ondanks eerdere waarschuwingen en de verstrekte tijd om verbeteringen door te voeren. Het OLB erkent zelf dat de bescherming van persoonsgegevens niet ‘optimaal’ is en dat er nog veel moet gebeuren. De informatie die het OLB tot nu toe heeft verstrekt, geeft onvoldoende vertrouwen dat de aanbevolen maatregelen daadwerkelijk zijn geïmplementeerd en dat de persoonsgegevens van burgers in de nabije toekomst adequaat zullen worden beschermd.
Gezien de ernst van deze situatie, acht de Commissie het noodzakelijk om de eerder aangekondigde last onder dwangsom nu daadwerkelijk op te leggen. Deze maatregel is bedoeld om het OLB ertoe te bewegen alsnog alle vereiste organisatorische en technische beveiligingen door te voeren. Het nalaten hiervan kan leiden tot verdere schendingen van de privacywetgeving, met mogelijke ernstige gevolgen voor de privacy van burgers.
Onaangekondigde controles
Na het verstrijken van de termijn van vier weken zal CBP BES onaangekondigde controles uitvoeren om de voortgang te monitoren. Deze controles zijn van belang om te verifiëren in hoeverre het OLB de benodigde maatregelen heeft genomen om de privacy van inwoners te beschermen. Als bij deze controles blijkt dat de maatregelen onvoldoende zijn uitgevoerd, zal de opgelegde dwangsom worden geïnd, wat kan oplopen tot $90.000.
CBP BES dringt erop aan dat de bescherming van persoonsgegevens een prioriteit is voor alle overheidsorganisaties. Burgers hebben recht op een veilige verwerking van hun gegevens, en het OLB draagt hierin een grote verantwoordelijkheid.
Het uitblijven van de juiste maatregelen kan ernstige gevolgen hebben voor de privacy en veiligheid van de burgers van Bonaire, Sint-Eustatius en Saba.

CBP BES IMPOSES A CORRECTIVE ADMINISTRATIVE SANCTION ON PUBLIC ENTITY BONAIRE FOR REPEATED VIOLATION OF PRIVACY LEGISLATION
Kralendijk,- The Commission Supervision Personal Data Protection BES (CBP BES) has decided to impose a corrective administrative sanction on the Public Entity Bonaire (OLB) with immediate effect. The decision stems from the repeated failure to comply with crucial arrangements regarding the protection of personal data of citizens on Bonaire. Despite repeated warnings, the OLB failed to implement necessary measures, leaving the personal data of citizens still vulnerable to misuse.
Response of the OLB
In a response dated 23 September 2024 to the intention of the Commission to impose a corrective administrative sanction, the OLB indicated that financial resources were made available in 2022 and 2023 to implement the recommendations of CBP BES and that a number of measures were carried out. Nevertheless, the OLB failed to implement all required measures in a timely and complete manner. The OLB gives organisational obstacles as the reason, e.g. the dispersion of civil servants over several buildings and limited working space.
Although the OLB indicates that some progress has been made, including the introduction of access badges and the replacement of non-lockable cabinets, the protection of personal data continues to be severely lacking. This is of concern to the Commission.
Assessment of the opinion
CBP BES is concerned that the personal data of citizens are still insufficiently protected, despite previous warnings and the time provided to implement improvements. The OLB itself acknowledges that the protection of personal data is not ‘optimal’ and that much remains to be done. The information provided so far by the OLB does not provide sufficient confidence that the recommended measures have actually been implemented and that the personal data of citizens will be adequately protected in the near future.
Given the gravity of this situation, the Commission now considers it necessary to effectively impose the previously announced corrective administrative sanction. This measure is aimed at prompting the OLB to yet implement all required organisational and technical safeguards. Failure to do so could lead to further violations of the privacy legislation, with potentially serious consequences for the privacy of citizens.
Unannounced audits
After the expiry of the four-week period, CBP BES will conduct unannounced audits to monitor the progress. These audits are important to verify the extent to which the OLB has taken the
necessary measures to protect the privacy of citizens. If these audits reveal inadequate implementation of the measures, the corrective administrative sanction imposed will be collected, which could rise to $90,000.
CBP BES insists that the protection of personal data is a priority for all government organisations. Citizens are entitled to secure processing of their data, and the OLB bears great responsibility in this regard.
