HERZIENINGSWET WOLBES EN FINBES NAAR RAAD VAN STATE.

Staatssecretaris van Binnenlandse Zaken en Koninkrijksrelaties Eric van der Burg kan zijn voorgenomen wijziging van de Wet openbare lichamen Bonaire, Sint Eustatius en Saba (WolBES) en de Wet financiën openbare lichamen Bonaire, Sint Eustatius en Saba (FinBES) naar de Raad van State sturen voor advies. Dat is vandaag in de ministerraad besloten. De WolBES en de FinBES gaan over het bestuur en de financiën van Bonaire, Sint Eustatius en Saba en ze regelen de verhouding met het Rijk. De wetten worden gewijzigd, om de bestuurlijke verhouding tussen de drie openbare lichamen en het Rijk te verbeteren en versterken en zorgen voor een betere dienstverlening aan inwoners.

Doen wat nodig is

De wijzigingen in de wet moeten eraan bijdragen dat de eilandsbesturen en de centrale overheid beter in staat zijn om te doen wat goed en nodig is voor het eiland en de inwoners. De WolBES en de FinBES helpen het lokale bestuur haar taken goed uit te voeren en zorgen voor de nodige democratische controle. Dit moet zorgen voor een betere dienstverlening aan inwoners, ondernemers en maatschappelijke organisaties. Voorbeelden hiervan zijn betere controle door de eilandsraad, het opzetten van een lokale rekenkamer en het behouden van de Rijksvertegenwoordiger.

Rijksvertegenwoordiger naast bestuur en bewoners

In dit wetsvoorstel blijft de functie van Rijksvertegenwoordiger behouden. Wel wordt het ambt anders ingericht. De Rijksvertegenwoordiger houdt zich bezig met goed bestuur en is verantwoordelijk voor interbestuurlijk toezicht. De Rijksvertegenwoordiger kan ook aan de bel trekken in Den Haag over onderwerpen die te weinig aandacht krijgen van de centrale overheid. Daarmee staat de Rijksvertegenwoordiger naast de bewoners en bestuurders van de eilanden.

Getrapt toezicht en lenen

Om het financieel toezicht op Bonaire, Sint Eustatius en Saba beter aan te sluiten op de eigenheid en ontwikkeling van de eilanden, wordt getrapt toezicht geïntroduceerd. Dit maakt maatwerk per eiland mogelijk. Het toezicht is licht waar het kan en zwaar waar het moet. Ook worden de leenmogelijkheden voor de eilandsbesturen uitgebreid om Bonaire, Sint Eustatius en Saba beter in staat te stellen hun taken goed uit te voeren. Net zoals gemeenten in Nederland, mogen Bonaire, Sint Eustatius en Saba leningen gaan afsluiten bij banken. Dat mag alleen voor de uitvoering van eilandelijke taken, bijvoorbeeld voor betere wegen en energievoorzieningen. Aan het lenen, zullen voorwaarden worden gesteld. Ook zal er toezicht zijn op het lenen door de eilanden. Zo worden de financiële risico’s beperkt.

Versterken bestuurskracht en democratie

Naast dit wetsvoorstel wordt met flankerend beleid en andere initiatieven, ingezet op het bevorderen van goed bestuur en de versterking van de bestuurskracht. Zo wordt de vrije uitkering aan de eilanden verhoogd, om de capaciteit van het kabinet van de gezaghebber en eilandgriffier te versterken. Ook wordt het meerjarig ondersteuningsprogramma voor de eilandsbesturen voortgezet. Hiermee krijgen politieke gezagsdragers sinds het najaar van 2024, coaching, training en opleidingen aangeboden. Tot slot wordt in samenwerking met ProDemos en het NIMD, het burgerschapsonderwijs en het democratisch bewustzijn van de bevolking versterkt.

BILL AMENDING THE WOLBES AND FINBES SENT TO THE COUNCIL OF STATE.

State Secretary of Interior and Kingdom Relations, Eric van der Burg, may send his proposed amendment to the Acts ‘Wet openbare lichamen Bonaire, Sint Eustatius en Saba (WolBES)’ and the ‘Wet financiën openbare lichamen Bonaire, Sint Eustatius en Saba (FinBES)’ to the Council of State for advice. This was decided today. The WolBES and the FinBES govern the administration and finances of Bonaire, St. Eustatius and Saba, and set out their relationship with the Kingdom. The laws are being amended to improve and strengthen the administrative relationship between the three public entities and the Kingdom, and to provide better services to residents.

Do what is needed

The amendments to the Acts should help the island governments and the central government do what is right and necessary for the islands and their residents. The WolBES and the FinBES help local government carry out its duties properly and provide the necessary democratic oversight. This should lead to better services to the residents, businesses and civil society organizations. Examples include stronger oversight by the Island Council, setting up a local audit chamber and keeping the Kingdom Representative.

Kingdom Representative alongside the administration and residents

This legislative proposal retains the position of Kingdom Representative, though the role is being restructured. The Kingdom Representative focuses on good governance and is responsible for inter-administrative oversight. They can also raise issues in The Hague that are receiving insufficient attention from the central government. In doing so, the Kingdom Representative stands alongside the island’s residents and administrators.

Tiered supervision and loans

To better align financial supervision with the unique characteristics and development of Bonaire, St. Eustatius and Saba, a system of tiered supervision is being introduced. This allows for a tailored approach for each island, ensuring supervision is light where possible and rigorous where necessary. Loan options for the island administrations are also being expanded to better enable Bonaire, St. Eustatius and Saba to effectively carry out their duties. Like municipalities in the Netherlands, Bonaire, St. Eustatius and Saba will be permitted to take out loans from banks. For instance, such borrowing is restricted to the execution of island-level tasks, like improving roads and energy infrastructure. Conditions will be attached to this borrowing, and the island’s borrowing activities will be subject to oversight, thereby limiting financial risks.

Strengthening administrative capacity and democracy

In addition to this legislative proposal, supporting policies and other initiatives are being deployed to promote good governance and strengthen administrative capacity. For instance, the ‘bijzondere uitkering’ to the islands is being increased to strengthen the capacity of the offices of the Island Governor and the island registrar. The multi-year support program for the island administrations is also being continued. Through this program, people holding political office have been offered coaching, training and educational courses since the autumn of 2024. Finally, citizenship education and democratic awareness among the population are being strengthened in collaboration with ProDemos and the NIMD.
