Kiko a bai robes?
NVWA na Hulanda ta ehersé e investigashon di laboratorio pa motibu di pregunta- i kehonan tokante e holó kímiko di e produkto.
Te asina leu ku ta konosí serka nos, esaki ta konta tambe pa e sobra islanan di BES i Sint Maarten, Kòrsou,Aruba. Tanten ku esaki falta, nos no por determiná e komposishon eksakto di e ko’i hunga aki i e gel niun kaminda den e region mes. Ademas, no ta kla kua instansia supervisor na Boneiru ta enkargá ku e tipo di susesonan aki; pa produktonan ku no ta kuminda (non-food products) manera ko’i hunga, no ta kla unda mester bati na porta, parse ku e no ta regla ainda. Tambe ta falta e posibilidat pa por kita produkto inseguro òf peligroso for di merkado nos mes, pa motibu ku no tin kobertura hurídiko pa esaki.

NEDERLAND:
ENGELS:
POSSIBLY UNSAFE CHILDREN’S TOYS ON BONAIRE: VIGILANCE REQUIRED
Kralendijk,- The ‘Squishy Dumpling’, a soft, gel-filled cushion in the shape of an Asian dumpling, is the focus of a consumer demand and received notification that affects us all. Fundashon Tienda pa Konsumidó Boneriano received a report of a child on Bonaire who developed a rash on the face after the toy tore open while playing. The Toy Store on Bonaire responded positively to voluntarily remove these types of toys from the shelves after they were approached with the complaint and the request to give their cooperation to protect children on Bonaire. FTPKB wants to use this incident to open a broader conversation: do we have the resources on our island to check the safety of these types of products, and which authority is responsible for this?
What went wrong?
The toys in question are sold at a local toy store in an ochre yellow plastic container. With the similar example that FTPKB purchased itself, the organization noticed a strong acetone-like and petrol-like smell. This is a personal observation that has not been confirmed by a laboratory, but it is an indication that it may contain volatile organic compounds (VOCs). The NVWA is currently investigating squishy toys and squishy dumplings: squeezable toys made of foam or filled with a gel or water balls in the shape of, for example, a dumpling. This product is a global hype on social media. The NVWA in the Netherlands carries out the laboratory investigation in response to questions and complaints about the chemical smell of the product. In a first step in the investigation, it has been shown that (VOCs) are present in the toy. These can cause a chemical odor in small quantities. For example, in larger quantities and with longer exposure, they can cause irritation to the respiratory tract, according to the study. The NVWA is still investigating how many of the substances are in the products. (Source: Dutch Food and Consumer Product Safety Authority) British regulator OPSS also previously recalled a similar product because of too high a benzene content, a substance that can cause skin irritation. It should be noted that it was a different copy and a different distributor; an exact link to the product on Bonaire has therefore not been made. A definitive judgment is only possible after laboratory testing, but precaution is justified here, precisely because it concerns toys for a vulnerable group (children). Testing chemical products is not a one-off challenge on Bonaire. In 2024, there were eggs on the market on Bonaire that turned out to be contaminated with creolin; Consumers only noticed this because the eggs had a chemical taste and black spots. There was no official confirmation by a laboratory, because even then testing for chemical substances was not possible. Sending products to test abroad is quite pricey. To this end, structural funding for FTPKB is aimed at testing products for the presence of chemical substances that can have consequences for the health of consumers.
The real question: “Where can Bonaire have unsafe products tested?”
The most worrying thing is not the loose toys themselves, but the broader issue behind them: Bonaire still lacks the possibility to determine the chemical composition of such products locally. As far as we know, this also applies to the sister islands of Sint Maarten, Curaçao and Aruba. The laboratories available there focus mainly on medical, clinical and microbiological analyses and, as far as we know, do not have the necessary facilities for the chemical testing of consumer products. Samples therefore typically need to be sent to specialized laboratories outside the region. BonLab can carry out research into microbiological contaminations, but does not have the equipment and analysis methods to determine possible chemical substances in toys and food. Realizing that research opportunity requires a considerable investment, individually perhaps too large for one small island. But it is not just about one island. Together, Bonaire, Sint Eustatius, Saba, Curaçao, Aruba and Sint Maarten have about 340,000 inhabitants, a significant proportion of whom are children, while according to our research and inquiries there is not a single chemical test site available for such products in the entire region. That is a large number of Dutch citizens outside the European part of the Kingdom, a community that deserves just as much protection. Therefore, if they share that facility as a whole, that investment is not only justified, but also realistic and achievable. As long as that is missing, we cannot determine the exact composition of these toys and the gel anywhere in the region. And that raises a fundamental question: “how much is the health of about three hundred and forty thousand inhabitants of the Caribbean part of the empire actually worth?” In addition, it is not clear which supervisory authority on Bonaire is competent for these types of incidents; For “non-food products” such as toys, it is unclear where the reports should be made. There is also no possibility to remove unsafe or dangerous products from the market yourself because there is no legal cover for this. It would be worthwhile to explore with relevant agencies and retailers how these gaps can be addressed, not only for these toys, but for every product that enters our island.
There is legal space
The lack of clarity around enforcement does not mean that there are no legal options. For example, the BES legislation contains provisions on product liability: “the producer is responsible for damage resulting from a defect in his product”. Anyone who imports a product for sale is considered a producer in this context. A reseller may also be held liable if the producer cannot be identified unless he discloses his identity in good time. Damage due to bodily injury falls within this scheme; Both parents on behalf of their children and organizations on behalf of victims can appeal to this. FTPKB has been made aware of this legal space by the local “Huridiko Counter”, which thus offers a concrete way for consumers to come into their own. For traders in products that may endanger the safety of consumers, this is an important fact to take into account. The financial consequences can be considerable.
Appeal to the community
After approaching FTPKB, the toy store in question has promised not to sell the product in question anymore. FTPKB requests that anyone who has purchased a Squishy Dumpling for their children not to use the toy for the time being, to keep it away from children and to contact info@tiendapakonsumido.com or 00599 717 3569 if you have any questions. In case of skin irritation or other complaints, we recommend consulting a doctor. We hope that this incident will encourage our island to have a constructive conversation about the protection of consumers, and in particular vulnerable groups, especially children. . A child deserves a safe toy that we can rely on, and a living environment that can actually control trust.
