TWEEDE KAMER STEMT IN MET DE WET BESCHERMING TEGEN DISCRIMINATIE OP BONAIRE, SINT EUSTATIUS EN SABA.

Kralendijk,- De Tweede Kamer heeft op dinsdag 18 februari 2025 ingestemd met de invoering van de gelijke behandelingswetgeving op Bonaire, Sint Eustatius en Saba.

Op basis van artikel 1 van de Grondwet gelden in Nederland diverse wetten die gelijke behandeling waarborgen. Op Bonaire, Sint Eustatius en Saba gelden deze wetten nu nog niet. Het uitgangspunt is dat wetgeving voor heel Nederland  moet gelden, tenzij er een goede reden is om hiervan af te wijken.

Uit onderzoek blijkt dat het wetsvoorstel, dat de gelijke behandelingswetten invoert, goed uitvoerbaar en belangrijk is voor de inwoners van Bonaire, Sint Eustatius en Saba. Daarom werkt het kabinet, mede op verzoek van de bestuurscolleges, aan de invoering van deze wetgeving op de eilanden. Daar kunnen inwoners straks een beroep op doen als zij zich gediscrimineerd voelen. Om hulp en bijstand bij discriminatie te krijgen, kunnen inwoners naar een antidiscriminatie-voorziening stappen. Deze voorziening wordt ondergebracht bij het loket voor kosteloze rechtshulp, dat voor elk eiland in voorbereiding is.

Vervolg in de Eerste Kamer

Het wetsvoorstel wordt nu naar de Eerste Kamer gezonden voor behandeling. Het wordt definitief als de Eerste Kamer ook instemt.

HOUSE OF REPRESENTATIVES APPROVES THE ANTI-DISCRIMINATION PROTECTION ACT IN BONAIRE, ST. EUSTATIUS AND SABA.

Kralendijk,- On Tuesday, 18 February 2025, the House of Representatives approved the introduction of equal treatment legislation in Bonaire, St. Eustatius, and Saba.

Based on Article 1 of the Dutch Constitution, various laws ensuring equal treatment apply in the Netherlands. However, these laws do not yet apply in Bonaire, St. Eustatius, and Saba. The general principle is that legislation should apply throughout the entire Kingdom of the Netherlands, unless there is a valid reason to make an exception.

Research shows that the proposed law, which introduces the equal treatment laws, is both feasible and important for the residents of Bonaire, St. Eustatius, and Saba. As a result, the central government, at the request of the executive councils, is working to implement this legislation on the islands. Residents will be able to use this law if they feel discriminated against. For assistance and support regarding discrimination, residents can approach an anti-discrimination service. This service will be integrated into the free legal aid office, which is currently being prepared for each island.

Follow up in the Senate

The draft law will now be sent to the Senate for consideration. It will be finalized if the Senate also approves it.
