SINT MAARTEN PUBLICEERT WETGEVING INZAKE HET VAN HET DEPOSITOGARANTIESTELSEL VOOR SINT MAARTEN
Philipsburg,- De Centrale Bank van Curaçao en Sint Maarten (CBCS) is gestart met de implementatie van het depositogarantiestelsel (DGS) voor Sint Maarten, volgend op de publicatie van het landsbesluit op 14 augustus 2026 (AB 2026, nr. 29).
Op dezelfde datum ondertekende de Minister van Financiën van Sint Maarten een ministeriële regeling waarin het DGS nader wordt uitgewerkt (AB 2026, nr. 31).
Het DGS voor Sint Maarten treedt op 28 september 2026 in werking. Met de invoering van het DGS zijn depositohouders binnen de gehele monetaire unie voortaan beschermd door een depositogarantiestelsel.
Dit draagt bij aan het vertrouwen in het financiële systeem en versterkt de stabiliteit van de monetaire unie. De wetgeving inzake het DGS is van toepassing op kredietinstellingen die van de CBCS een vergunning hebben om op Sint Maarten het bedrijf van kredietinstelling uit te oefenen.
Het DGS beschermt depositohouders wanneer een kredietinstelling niet langer aan haar verplichtingen kan voldoen.
Deposito’s zijn beschermd tot Cg 50.000 per rekeninghouder per bank en tot Cg 25.000 per rekeninghouder per kredietunie. Het DGS zorgt ervoor dat getroffen rekeninghouders het beschermde deel van hun deposito’s binnen 20 werkdagen ontvangen.
De financiering hiervoor wordt verstrekt door het depositogarantiefonds, dat zal worden beheerd door de Stichting Depositogarantiefonds Sint Maarten (DGF), opgericht door de CBCS. Kredietinstellingen zijn verplicht om jaarlijks een reguliere bijdrage te betalen aan het depositogarantiefonds. Deze bijdragen worden gebaseerd op het volume aan gegarandeerde deposito’s dat bij iedere instelling wordt aangehouden.
De CBCS en de Stichting DGF zijn gezamenlijk verantwoordelijk voor de uitvoering van de taken en activiteiten die verband houden met het DGS. De CBCS zal nauw blijven samenwerken met relevante belanghebbenden om het publiek te informeren over de werking en voordelen van het DGS.
Ter ondersteuning hiervan heeft de CBCS een speciale DGS-website gelanceerd, waarop uitgebreide informatie beschikbaar is.

CBCS STARTS IMPLEMENTATION OF SINT MAARTEN DEPOSIT GUARANTEE SCHEME
Philipsburg,- The Centrale Bank van Curaçao en Sint Maarten (CBCS) is implementing the Deposit Guarantee Scheme (DGS) for Sint Maarten following the publication of the national decree on August 14, 2026 (AB 2026, no. 29).
On the same date, the Minister of Finance of Sint Maarten signed a ministerial regulation further elaborating the DGS (AB 2026, no. 31). The DGS for Sint Maarten will enter into effect on September 28, 2026. With the introduction, depositors throughout the monetary union will be covered by a deposit guarantee scheme, further strengthening confidence in the financial system and the stability of the monetary union.
The DGS legislation applies to credit institutions licensed by the CBCS to conduct the business of a credit institution in Sint Maarten.
The DGS protects depositors if a credit institution can no longer meet its obligations. Deposits are protected up to Cg 50,000 per account holder per bank and up to Cg 25,000 per account holder per credit union.
The DGS ensures that affected account holders receive the protected portion of their deposits within 20 business days. Funding for this purpose is provided by the Deposit Guarantee Fund (DGF), which will be managed by the Deposit Guarantee Fund Foundation Sint Maarten, established by the CBCS.
Credit institutions are required to make regular annual contributions to the DGF based on the volume of guaranteed deposits held at each institution.
The CBCS and the DGF Foundation will be jointly responsible for carrying out the tasks and activities related to the DGS.
The CBCS will continue to work closely with relevant stakeholders to inform the public about the functioning and benefits of the DGS.
