Kralendijk,- De Raad voor de leefomgeving en infrastructuur (Rli), een onafhankelijke adviesraad van de Nederlandse regering, heeft een kritisch rapport gepubliceerd met de titel ‘Samen naar beter’.

Het rapport bevestigt dat de bescherming van gezondheid, milieu en levenskwaliteit op Bonaire achterblijft in vergelijking met Nederland.

Voor de Fundashon Tienda pa Konsumidó Boneriano (FTpKB) is dit officiële advies een duidelijke erkenning van de problemen die wij al geruime tijd signaleren en een fundamentele steun in onze strijd voor rechtvaardige consumentenrechten.

Het rapport van de Rli identificeert een “ongewenst verschil” in beleid dat directe gevolgen heeft voor onze gemeenschap.

Dit manifesteert zich op verschillende cruciale gebieden voor consumenten:

Een van de meest alarmerende punten die de stichting constateert, is het gebrek aan veiligheid van geïmporteerde producten.

In Nederland worden consumenten naast nationale wetten ook beschermd door strikte EU-wetgeving, maar op Bonaire is het wettelijk kader zeer zwak.

Dit betekent dat producten die in Nederland en andere landen worden afgekeurd vanwege risico’s voor de menselijke of dierlijke gezondheid, op onze markt gewoonm beschikbaar zijn en zelfs al lange tijd in omloop zijn.

Consumenten kopen en gebruiken deze producten in hun huishouden zonder te weten dat hun gezondheid gevaar loopt.

Bovendien, wanneer er een geschil ontstaat bij transacties van producten of diensten, bevindt de consument zich in een kwetsbare positie en is hij genoodzaakt dure civiele rechtszaken te starten tegen bedrijven die zich bewust zijn van de situatie en er misbruik van maken, omdat zij wél een advocaat kunnen betalen en de consument vaak niet.

Ook het universele recht op duidelijke en begrijpelijke informatie wordt in veel gevallen op onze markt niet gerespecteerd.

Onvolledige etiketten, in een voor de consument onbekende taal, of misleidende informatie belemmeren de consument bij het nemen van verantwoorde en goed geïnformeerde beslissingen. Dit is geen kleine fout, maar een schending van een fundamenteel recht.

Het rapport benadrukt dat het ‘pas toe of leg uit’-principe (waarbij Nederlands beleid ook hier zou moeten gelden) in de praktijk heeft gefaald. Wetten die onze mensen in Nederland beschermen, bestaan hier simpelweg niet of zijn zo verouderd dat ze niet meer functioneren voor het Bonaire van vandaag, een eiland in volle ontwikkeling.

De speciale status van Bonaire mag niet leiden tot minder bescherming; het vereist een intelligente en effectieve implementatie van moderne normen.

De FTPKB steunt de aanbevelingen van de Rli en reikt de hand aan zowel de lokale overheid als de regering van het Koninkrijk om samen te werken. We kunnen niet langer wachten. Laten we deze gelegenheid aangrijpen om:

1. Duidelijke ambitieniveaus vast te stellen specifiek voor consumentenbescherming in onze Bonairiaanse context.
2. De wetgeving te moderniseren en de handhaving te optimaliseren via een gezamenlijk en concreet programma.

Kralendijk,- The Council for the Environment and Infrastructure (Rli), an independent advisory body to the Dutch government, has published a critical report titled ‘Samen naar beter’ (Together for Better). The report confirms that the protection of health, the environment, and quality of life on Bonaire is lagging behind compared to the Netherlands.

For the Fundashon Tienda pa Konsumidó Boneriano (FTpKB), this official advice is a clear acknowledgment of the problems we have been highlighting for a considerable time and fundamental support in our fight for fair consumer rights.

The Rli report identifies an “undesirable difference” in policy that has direct consequences for our community.

This is evident in several crucial areas for consumers:

One of the most alarming points noted by the foundation is the lack of safety of imported products. In the Netherlands, consumers are protected by strict EU legislation in addition to national laws, but on Bonaire, the legal framework is very weak.

This means that products rejected in the Netherlands and other countries due to risks to human or animal health are simply available on our market and have even been in circulation for a long time.

Consumers buy and use these products in their households without knowing their health is at risk. Furthermore, when a dispute arises in transactions involving products or services, the consumer is in a vulnerable position, forced to initiate expensive civil lawsuits against companies that are aware of the situation and take advantage of it, because they can afford a lawyer and the consumer often cannot.

The universal right to clear and understandable information is also not respected in many cases in our market. Incomplete labels, in a language unknown to the consumer, or misleading information prevent the consumer from making responsible and well-informed decisions. This is not a minor error, but a violation of a fundamental right.

The report emphasizes that the ‘apply or explain’ principle (whereby Dutch policy should also apply here) has failed in practice. Laws that protect our people in the Netherlands simply do not exist here or are so outdated that they no longer function for the Bonaire of today, an island in full development. The special status of Bonaire cannot mean less protection; it requires an intelligent and effective implementation of modern standards.

The FTpKB supports the Rli’s recommendations and extends a hand to both the local government and the government of the Kingdom to work together. We can wait no longer. Let us seize this opportunity to:

1. Establish clear ambition levels specifically for consumer protection in our Bonairean context.
2. Modernize legislation and optimize enforcement through a joint and concrete program.
3. Make the necessary investments to place the well-being and rights of the Bonairean community as a central priority.

El informe confirma que la protección de la salud, el medio ambiente y la calidad de vida en Bonaire está rezagada en comparación con los Países Bajos. Para la Fundashon Tienda pa Konsumidó Boneriano (FTpKB), este dictamen oficial es un claro reconocimiento de los problemas que llevamos tiempo señalando y un apoyo fundamental en nuestra lucha por los derechos justos para el consumidor.

Los consumidores compran y utilizan estos productos en sus hogares sin saber que su salud está en peligro. Además, cuando surge una disputa en las transacciones de productos o servicios, el consumidor se encuentra en una posición vulnerable, viéndose obligado a iniciar costosos procesos civiles contra empresas que son conscientes de la situación y se aprovechan de ella, porque ellas sí pueden pagar un abogado y el consumidor a menudo no.

El derecho universal a una información clara y comprensible tampoco se respeta en muchos casos en nuestro mercado. Etiquetas incompletas, en un idioma desconocido para el consumidor, o información engañosa impiden que el consumidor tome decisiones responsables y bien informadas. Esto no es un error menor, sino una violación de un derecho fundamental.

El informe subraya que el principio de “aplicar o explicar” (según el cual la política neerlandesa también debería aplicarse aquí) ha fracasado en la práctica. Las leyes que protegen a nuestra gente en los Países Bajos simplemente no existen aquí o están tan anticuadas que ya no son funcionales para el Bonaire de hoy, una isla en pleno desarrollo.

El estatus especial de Bonaire no puede significar menos protección; requiere una implementación inteligente y efectiva de normas modernas.

La FTpKB apoya las recomendaciones del Rli y tiende la mano tanto al gobierno local como al gobierno del Reino para trabajar juntos. No podemos esperar más. Aprovechemos esta oportunidad para:
