BESCHERMINGSCODE VAN KRACHT VANAF 1 JANUARI 2025

Kralendijk, – Vanaf 1 januari 2025 geldt het Besluit maatschappelijke ondersteuning en bestrijding huiselijk geweld en kindermishandeling BES op Bonaire, Sint Eustatius en Saba. Dit besluit zet een belangrijke stap richting een veilige, zorgzame samenleving en biedt inwoners en zorgprofessionals betere ondersteuning bij het voorkomen en aanpakken van huiselijk geweld en kindermishandeling (HGKM).

Maatschappelijke Ondersteuning

Het besluit richt zich op drie belangrijke gebieden. Allereerst wordt maatschappelijke ondersteuning beter georganiseerd, zodat mensen zo lang mogelijk zelfstandig thuis kunnen blijven wonen. Denk hierbij aan hulpmiddelen, maar ook huishoudelijke hulp of dagopvang gelden als maatschappelijke ondersteuning.

Adviespunt

 Ten tweede kunnen burgers en professionals vanaf 2025 met zorgen of signalen van huiselijk geweld en kindermishandeling terecht bij een speciaal adviespunt. Voor professionals is een meldrecht vastgelegd, wat hen onder duidelijke voorwaarden toestaat om een melding te doen bij vermoedens van geweld.

Beschermingscode voor professionals

Ten derde zijn organisaties vanaf 1 januari 2025 verplicht om een Beschermingscode op te stellen. De code bestaat uit vijf stappen die door professionals gevolgd moeten worden bij het signaleren en melden van vermoedens van kindermishandeling of huiselijk geweld. De Beschermingscode biedt professionals duidelijkheid wat er van hen verwacht wordt als bij hen vermoedens ontstaan van huiselijk geweld of kindermishandeling. Voor de burgers van de eilanden betekent de Beschermingscode dat de professional zorgvuldig te werk gaat en zijn vermoedens eerst met de cliënt of de ouders bespreekt voordat hij of zij een melding doet. De Beschermingscode wordt in de verschillende talen van Caribisch Nederland aangeduid als Kódigo di Protekshon in het Papiamentu en Protection Code in het Engels.

Met dit besluit wordt een belangrijke stap gezet richting een veilige en zorgzame samenleving voor alle inwoners van Caribisch Nederland.

PROTECTION CODE EFFECTIVE FROM THE 1^ST OF JANUARY 2025

Kralendij, -kAs of the 1^st of January 2025, the Social Support and Combating Domestic Violence and Child Abuse Decree BES will apply to Bonaire, St. Eustatius, and Saba. This decree marks an important step towards a safe, caring society and provides residents and care professionals with better support in preventing and addressing domestic violence and child abuse (DVCA).

Social Support

The decree focuses on three key areas. First, social support will be better organized to enable people to live independently at home for as long as possible. This includes tools and resources such as household help and day care services, which are also considered forms of social support.

Advice Center

Secondly, citizens and professionals who are concerned about or have indications of domestic violence or child abuse can turn to a dedicated advice center as of 2025. For professionals, a reporting right has been established, which allows them to file a report under clear conditions if there is a suspicion of violence.

Protection Code for Professionals

Thirdly, from the 1^st of January 2025, organizations will be required to establish a Protection Code. The code consists of five steps that professionals must follow when identifying and reporting suspected cases of child abuse or domestic violence. The Protection Code provides professionals with clarity on what is expected of them when they suspect domestic violence or child abuse.

For the citizens of the islands, the Protection Code ensures that professionals act carefully and first discuss their concerns with the client or the parents before filing a report. The Protection Code is referred to in the different languages of the Caribbean Netherlands as Kódigo di Protekshon in Papiamentu and Beschermingscode in Dutch.
